General Terms & Conditions
Allgemeine Geschäftsbedingungen (AGB)

These General Terms and Conditions govern the accommodation and services provided by TKB Hotels GmbH, Garnisongasse 4/11, 1090 Wien, Austria ("the Hotel") to its guests ("the Guest"). Austrian law applies.

1. Scope of Application

These terms apply to all accommodation contracts, event bookings, and related services concluded with TKB Hotels GmbH. Deviating terms of the Guest do not apply unless expressly agreed in writing.

2. Booking & Confirmation

A reservation is binding upon written confirmation by the Hotel (by email or letter). The Guest is responsible for ensuring that the contact details provided are accurate. The booking confirmation sets out the agreed services, dates, prices, and any applicable special conditions.

3. Prices & Payment

All prices are stated in Euros (€) and include Austrian VAT (currently 10% for accommodation, 20% for food and beverages) unless otherwise stated. The Hotel accepts cash, major debit and credit cards. Payment is due upon check-out unless otherwise agreed. The Hotel may request a credit card guarantee or advance deposit at the time of booking.

4. Check-in & Check-out

Check-in is available from 14:00. Check-out must be completed by 11:00. Late check-out beyond 11:00 may be subject to an additional charge subject to availability. Early check-in and late check-out can be arranged upon request.

5. Cancellation & No-Show Policy

The following cancellation conditions apply unless a different cancellation policy is specified in the booking confirmation:

• Cancellation more than 7 days before arrival: No charge.
• Cancellation 3–7 days before arrival: 50% of the total booking value will be charged.
• Cancellation less than 3 days before arrival or no-show: 100% of the total booking value will be charged.

Cancellations must be notified in writing (by email to office@hotel-herzoghof.at). The date of receipt of the written cancellation is decisive. In the event of force majeure (e.g. natural disaster, government travel ban), the Hotel will endeavour to find a mutually acceptable solution.

6. Room Allocation & Changes

The Hotel reserves the right to accommodate the Guest in a room of equivalent or higher category in the event that the reserved room type is unavailable due to circumstances beyond the Hotel's control, without any additional charge to the Guest. If only a lower category is available, the Hotel will offer an appropriate price reduction or cancellation without penalty.

7. Guest Obligations

Guests are requested to treat Hotel property with care. Any damage caused by the Guest to Hotel property will be charged at replacement or repair cost. Smoking is not permitted in any indoor area of the Hotel. Smoking areas are designated outside the building. Excessive noise disturbance to other guests may result in the Guest being asked to vacate the premises without refund.

8. Pets

Well-behaved pets are welcome at Hotel Herzoghof. A per-night surcharge applies; please enquire at the time of booking. Pets must not be left unattended in guest rooms. The Guest is liable for any damage caused by their pet.

9. Liability

The Hotel is liable for damage caused by its employees or agents to the extent required by law. Liability for items brought onto Hotel premises is governed by §§ 970 et seq. of the Austrian Civil Code (ABGB). The Hotel recommends the use of the in-room safe for valuables. The Hotel is not liable for valuables not deposited in the safe.

The Hotel is not liable for service disruptions caused by force majeure, strikes, or other events beyond its control.

10. Event & Seminar Bookings

For seminar, event, and private function bookings, a separate event contract will be concluded specifying room hire fees, catering arrangements, minimum spend, technical requirements, and cancellation terms applicable to that booking. The present AGB apply subsidiarily to the extent not contradicted by the event contract.

11. Data Protection

The Hotel processes guest personal data in accordance with its Privacy Policy (Datenschutzerklärung), available at datenschutz.html, and in compliance with the GDPR and DSG 2018.

12. Governing Law & Jurisdiction

These terms are governed by Austrian law, excluding its conflict of law provisions. The place of jurisdiction for any disputes arising from this agreement is Baden bei Wien, Austria, to the extent permitted by law.

13. Amendments

The Hotel reserves the right to amend these terms at any time. The version in force at the time of booking applies to each individual contract.
